User Agreement & Policies

Welcome to Custom Logo USA.com, Inc. ("CustomLogoUSA"). Custom Logo USA provides its website and related services ("Site") to you subject to the following User Agreement ("Agreement"), which may be updated from time to time without notice to you. Your continued use of the Custom Logo USA Site after any such changes constitutes your acceptance of the new terms. Before you use the Custom Logo USA.com web site, please read the terms and conditions that govern your use of the site. By continuing to use the site, you are indicating your agreement to be bound by the terms of this agreement and all revisions thereof.
You shall use Custom Logo USA.com for lawful purposes only. You shall not upload, download, post, email or otherwise transmit through CustomLogoUSA.com any material which violates or infringes in any way upon the rights of others, which is unlawful, abusive, defamatory, threatening, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, or which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, including use that infringes on any patent, trademark, copyright or other proprietary rights of any third party. We reserve the right, in our sole discretion, to refuse to produce goods and/or to terminate your access to CustomLogoUSA.com for any breach of this provision or any other provision of this Agreement. You acknowledge that Custom Logo USA does not pre-screen submitted Content, but that Custom Logo USA and its designees shall have the right, but not the obligation, in their sole discretion to reject or remove any Content that is available via the Site. Upon placing your order, you acknowledge that Custom Logo USA may review your order and the Content it contains, for adherence to our guidelines and compliance with the terms and conditions set forth in this User Agreement. Custom Logo USA and its designees shall have the right to remove any Content that violates the Agreement or is otherwise objectionable to Custom Logo USA. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content, created by or submitted to, CustomLogoUSA. You acknowledge and agree that you are responsible for the creation and compilation of your Content, and that neither Custom Logo USA nor any other party involved with the production of any product incorporating such Content assumes that responsibility. Custom Logo USA's production of any product depicting your Content does not indicate that Custom Logo USA approves of the Content, that the Content obeys all applicable laws, or that you are absolved of any liability or harm arising from the use of the Content. In accepting these terms, you agree not to publish, reproduce, copy, in whole or in part or otherwise distribute Content available through the Site including code and software, in violation of applicable copyright and other intellectual property laws. By submitting Content to Custom Logo USA, you grant Custom Logo USA a license to copy, crop, reproduce, display, and distribute your Content.

Privacy Policy

Your privacy is very important to Custom Logo USA and we will not give or sell anyone specific information about you or any orders you have placed through the CustomLogoUSA.com web site except Custom Logo USA may share information about you or an order you have placed with an institution to review the use of Licensed marks as necessary. We use return email addresses to answer email we receive. Custom Logo USA will not send you unsolicited materials except that customers who register design accounts may receive occasional e-mails in regards to changes in service, specials and new features. CustomLogoUSA.com uses cookies to store information about items you are purchasing.  We do not store any personal or secure information in the cookie.  You must set your browser to accept cookies if it does not already.  For assistance in doing this you can email customerservice@customlogousa.com with the type of browser you are using.     

Artwork Policy

By submitting artwork to CustomLogoUSA.com you warrant that you have the right to use, copy and distribute each copyright, service mark, trademark, trade name, logo, artwork, graphic, name, statement, photograph, portrait, picture or illusion of any person or any other intellectual property in the way it is to be printed on or otherwise applied to the products ordered by you from CustomLogoUSA.com. You warrant that you have not violated the property rights of any third party in obtaining material and submitting it to CustomLogoUSA.com for reproduction. You agree to indemnify and hold CustomLogoUSA.com and its owners, officers, employees and agents harmless from and against any suit, demand, claim, loss, liability, damage or expense made against CustomLogoUSA.com by reason of breach of this warranty, and you agree to pay any judgment or settlement offer resulting from any suit, demand, or claim and to pay any attorney's fees incurred by CustomLogoUSA.com in defending against any such suit, demand or claim. The burden of determining that any material is not protected by trademark, service mark, copyright or other proprietary right rests solely with you. You are solely responsible for obtaining proper permissions and licenses, except as may be permitted by copyright law, from third parties whose rights may be violated or infringed by the use of any material protected by trademark, service mark, copyright or other proprietary right. A customer may not use any logo or other graphic material in a manner in which may infringe on copyright, trademark, service mark or other proprietary mark. A customer also may not use any logo or trademark in an unlawful manner. We assume no responsibility for damages or any wrong doing that the customer may cause using a logo, trademark or copyrighted items. You agree to indemnify and hold CustomLogoUSA.com harmless from and against any suit, demand, claim, loss, liability, damage or expense made against or incurred by CustomLogoUSA.com by reason of the unauthorized, improper, or illegal use of any logo or trademark or copyright that is printed on or otherwise applied to promotional merchandise ordered or purchased by the customer through CustomLogoUSA.com. All clip art images are the property of CustomLogoUSA.com or licensed from third party vendors unless otherwise stated. Designs created from the clip art provided are in no way the property of users or customers who create such designs. For this reason, designs created using the clip art library should never be resold. Return Policy

Custom Logo USA will gladly offer an exchange or refund on goods if there was a defect in the quality of your merchandise.  This includes if the material themselves were defective or flawed or if the merchandise was misprinted.  Custom Logo USA displays the colors and graphics of the products as accurate as possible and we cannot guarantee that your monitor’s display of any color and or graphic will be accurate.  The colors you see will depend on your monitor and may be slightly different from the actual colors of the product and therefore, Custom Logo USA will have no liability for any damages, returns for credit or otherwise as a result of any variance between the appearance of colors and or graphics displayed on your monitor and on the finished product purchased by you.

Custom Logo USA is dedicated to delivering you only the highest quality products and screen printing.  If the products you receive are misprinted or damaged in any way, you may return them for a full refund within 15 days of receiving them.  We only ask that you notify Custom Logo USA at customerservice@customlogousa.com before returning any merchandise so that we can work with you to quickly resolve the problem.

Payments & Security

Custom Logo USA accepts online payment by credit card or debit card.  We utilize Secure Sockets Layer (SSL) technology that encrypts all information you input before it is sent to us so that you can rest assured that your purchase is safe. Custom Logo USA will begin to process orders immediately upon verification that payment has been received. Custom Logo USA may accept payment by check or purchase order to qualified institution who wish to set up an account with Custom Logo USA. 

Disclaimer of Liability

You acknowledge that the use of the site is at your sole risk. Custom Logo USA will be responsible for acting only on those instructions sent to Custom Logo USA that are received and does not assume responsibility for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of any orders you send. Custom Logo USA is not responsible for any losses or delays in transmission of orders arising out of the use of any Internet Access Service Provider or caused by any browser software or any computer virus or related problem that may be attributable to services provided by any Internet Access Service Provider. Custom Logo USA is not responsible should you give incorrect instructions or if your credit-card payment is not processed by your credit-card company. The information and materials contained in this Site, including text, graphics, links or other items, are provided "as is", "as available". Custom Logo USA does not warrant the accuracy, adequacy or completeness of the information and materials on the Site and expressly disclaims liability for errors or omissions in this information and materials. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, and fitness for a particular purpose or freedom from computer virus, is given in conjunction with the information and materials. Our liability to you, if any, shall not exceed the total of the invoice for services and products provided on the transaction in dispute. We shall not be liable for indirect, incidental, consequential, reliance or special damages for harm to business, lost profits, lost savings or lost revenues, whether or not we have been advised of the possibility of such damages. We shall not be liable for any damage that you may suffer arising out of use, or inability to use, the services or products provided hereunder unless such damage is a caused intentional act of CustomLogoUSA.com. We shall not be liable for unauthorized access by third parties to your transmission facilities, premises or equipment or for unauthorized access to or alteration, theft, loss or destruction of users’ network, systems, applications, data files, programs, procedures, or information through accident, fraudulent means or devices, or any other method. These limitations of liability shall apply regardless of the form of action, whether in contract, warranty, strict liability or tort, and shall survive failure of an exclusive remedy. You agree to defend, indemnify and hold Custom Logo USA and Custom Logo USA's officers, directors, employees, agents and licensors harmless from all judgments, awards, losses, liabilities, costs and expenses, including but not limited to reasonable attorney's fees, expert witness fees, and costs of litigation arising out of or based on content you submit, post to or transmit through the Site, your use of the Site, your connection to the Site, your violation of the Agreement or your violation of any rights of a third party.  This agreement shall be governed by the laws of the state of New York and where applicable, by federal law.
